Dear user,

Welcome to the EveryDoggy app, a service that offers its users dog training educational content (courses, video lessons, training guides, etc.).

The actual functions of the EveryDoggy app may slightly differ between different app versions or different devices on which it is used.

The EveryDoggy app is operated by Star Focus, Inc. which is registered at 12655 W JEFFERSON BLVD, LOS ANGELES, the USA.

The following terms in this EveryDoggy User Agreement (hereinafter referred to as “this Agreement”) constitute a legally binding agreement between you and Star Focus (the USA) and its subsidiaries and affiliates (hereinafter referred to as “Star Focus”).

This Agreement stipulates your legal rights and responsibilities relating to the use of EveryDoggy and the relevant software, services and websites (hereinafter referred to as “this Service”). In this Agreement, “you” refers to any individual who uses and/or accesses this Service.

If you are a minor under 18 years old, you must obtain your parents’ and/or guardians’ consent to use this Service.

Before using this Service, you must agree to the terms in this Agreement. This document constitutes the terms made between you and Star Focus (hereinafter referred to as “the Terms”). Please ensure that you read the Terms carefully and select Agree to indicate that you have read and agree to the Terms.

To use this Service, you must be connected to the Internet and have a Huawei device. If you do not agree to all or part of the Terms, you will not be able to use, nor should you attempt to use this Service.

Some elements of this Service may be subject to subscription fees. Please refer to the Subscription Agreement for more details.

1. Third-party services

1.1 Your carrier or other third parties may also provide corresponding products and services on EveryDoggy. By using such third-party products and services, you acknowledge that you agree to the service terms stipulated by the third party. We strongly recommend that you read the content of third-party user agreements and privacy policies carefully. Star Focus is neither entitled to nor obliged to control or censor the content of third-party products and services, therefore Star Focus shall assume no liability in the event that your rights are infringed due to use of such products and services. Star Focus is not responsible for the content or availability of any third-party products or services and does not endorse and is not responsible in any way for any content, advertising, products, services, or other materials made available by your carrier or other third parties on the EveryDoggy app. In the event that you do not observe the content of the third-party user agreements and/or privacy policies, the third party may take legal action against you. Star Focus may be required to assist the third party or governmental authorities. You shall bear full legal liability in such events.

1.2 Any dispute caused by the use of third-party services through this Service shall be settled by the third party; Star Focus assumes no responsibility. Star Focus does not provide any customer support for third-party software or technology. If you require support, please contact the third party.

2. Risks and responsibilities

2.1 You shall bear any risks resulting from using the EveryDoggy app. Star Focus makes no warranties or representations of any kind, including that this Service and its results will satisfy your requirements or that the product’s services will not be interrupted, and does not guarantee the security, accuracy, integrity, timeliness, legality, or stability of this Service and its data. Star Focus shall assume no legal liability for any circumstances that result in you not being able to use the EveryDoggy app, including but not limited to faults with networks, communication lines, third-party websites, and service providers.

2.2 You undertake that you shall not directly or indirectly participate in behaviors that violate applicable laws or regulations in using any services provided by Star Focus and you hereby agree and undertake:
a) Not to gain or attempt to gain unauthorized access to, or impair any aspect of this Service or its related systems or networks;
b) Not to impersonate any person or falsely state or otherwise misrepresent your affiliation with a person or entity;
c) Not to use this Service (or any part(s) of it) in any unlawful manner, for any unlawful purpose, or in any manner inconsistent with this Agreement, or act fraudulently or maliciously, including without limitation, by hacking into or inserting malicious code, including viruses, or harmful data, into this Service (or into the websites linked to this Service) or any operating system;
d) Not to use this Service for commercial purposes without our prior written consent;
e) Not to solicit login information or access an account belonging to someone else;
f) Not to attempt, facilitate or encourage any violations of this Agreement (or any part(s) thereof);
g) Not to incite ethnic hatred or discrimination;
h) Not to spread obscenity, pornography, gambling, violence, terror, or instigate crimes.

2.3 Some services may need to make or receive phone calls, access mobile data, or send SMS messages. You may incur charges from third parties for such services. Star Focus will not collect any information that reveals your personal identity unless you provide such information yourself.

2.4 In the event that your behavior and/or uncontrollable circumstances result in the disclosure or leakage, or the acquisition, use, or transfer by a third party of any information that may relate to your privacy, property, or information which you believe to be private or proprietary information, Star Focus shall assume no liability and you shall be responsible for any adverse consequences resulting therefrom.

2.5 Certain jurisdictions may prohibit the exclusion of specific warranties or restrictions, or the exclusion of liability for specific damages. Therefore, some disclaimers and limitations of liability provisions set out in this Agreement may not apply to you. You expressly understand and agree that Star Focus, its subsidiaries, affiliates, officers, directors, employees, agents, partners, and licensors will not be liable to you for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, loss of goodwill, and other intangible losses (even if Star Focus has been advised of the possibility of such damages), in the event of:
a) Use of or inability to use this Service.
b) Changes to this Service, as well as any temporary or permanent cessation of all or part of this Service.
c) Unauthorized access to or alteration of your transmission or data.
d) Deletion, destruction or failure to store and/or transmit or receive transmissions or data you transmit through this Service.
e) Any statement or action by any third party in this Service.
f) Any other matters relating to this Service.

3. Intellectual property rights statement

3.1 Star Focus is the intellectual property right holder of this Service. All intellectual property rights of this Service, including copyright, design rights, trademark right, database rights, sui generis rights, patent right, and trade secrets, as well as all information related to this Service (including but not limited to text, logos, pictures, videos, charts, interface design, layout framework, relevant data, or electronic documents) are protected by national laws and regulations and international treaties. Star Focus enjoys the aforementioned intellectual property rights. Your access and/or use of any of this Service does not transfer to you or any other person any ownership or other rights in or to this Service or its content, unless specified otherwise in the Terms.

3.2 You shall not implement, utilize or transfer the aforementioned intellectual property rights or allow any third party to do so for any commercial or non-commercial purpose without the written consent of Star Focus. Star Focus reserves the right to pursue legal liability for any of the aforementioned behaviors.

4. Usage restrictions

During the term of this Agreement, Star Focus grants you a limited, revocable, non-exclusive, and non-transferable license to access this Service.

Due to location based copyright limitations, some of the content may not be available depending on where you are accessing this Service. Star Focus shall bear no responsibility if you are unable to use this Service due to copyright reasons.

Star Focus and its licensors own all intellectual property rights related to this Service. You may use this Service in accordance with this Agreement, provided that you respect all relevant laws, regulations, and policies in addition to the Terms contained herein. You are not entitled to, nor should you engage in any of the following behaviors, including but not limited to:

4.1 Deleting any copyright trademark or other proprietary notices or statements or any other information and/or content contained in this Service.

4.2 Engaging in reverse engineering, disassembly, decompiling, or creation of derivative works based on this Service in whole or in part, including attempts to do any of these, except in cases where such actions cannot be prohibited by applicable laws.

4.3 Using, copying, modifying, leasing, or transferring all or part of this Service outside the scope of the Terms stipulated in this Agreement, or permitting this Service or any part of it to be combined with, or become incorporated in, any other programs.

4.4 Making this Service available to a third party, licensing others to use this Service, or using this Service for a purpose forbidden by Star Focus (e.g. commercial purposes).

4.5 Performing the following actions to videos, images, text, and other relevant information contained in this Service, including but not limited to: using them for purposes other than private viewing, copying, selling, leasing, modifying, adding hyperlinks to, reusing, compiling, publishing, displaying in public, broadcasting, creating mirror sites, or using this Service to create related derivative products, works, and/or services.

4.6 Using this Service to store, publish, or disseminate content that infringes upon the accounts, intellectual property rights, trade secrets, or any other legal rights of Star Focus or third parties. Using Star Focus to collect information or data on third parties, destroy or steal third-party accounts, send illegal information such as fraud or junk mail, and infringe upon the legal rights and interests of Star Focus or third parties, including but not limited to privacy, intellectual property, and property rights.

4.7 Engaging in behavior that jeopardizes cyber security.

4.8 Providing any third party with your paid content or membership, whether free of charge or not, and allowing others to watch videos through your account that have not been purchased by them.

4.9 Developing, supporting, or using software, devices, scripts, robots, or any other means or processes (including crawlers, browser plug-ins and add-ons, or any other technology or manual work) to scrape this Service or otherwise copy profiles and other data from this Service.

5. Version updates

Star Focus reserves the right to decide whether to release updated versions of this Service in the future. If Star Focus decides to release an updated version of this Service, this Agreement shall remain applicable to the updated version, unless updated terms are released. By installing any updates, you acknowledge that you agree to abide by the relevant terms. If you do not agree to all of the content in the updated terms, do not install the update.

6. Termination of rights

6.1 The invalidity of any term in this Agreement, in whole or in part, shall not affect the validity of any other terms. Star Focus and/or its licensors reserve the right to suspend or terminate this Agreement at any time. You have the right to terminate this Agreement by ceasing to use this Service.
Upon termination of this Agreement, you must stop using this Service immediately and delete all related software and data that you have copied or installed.

6.2 If Star Focus finds or receives a report or complaint from others about a violation of provisions under this Agreement, Star Focus shall be entitled to delete any relevant content at any time, and, depending on the circumstances, take steps to protect itself and this Service against the violation, including but not limited to warning, limiting, or prohibiting the use of functions in part or in whole, banning and deactivating the account, and notifying the user of the actions taken.

6.3 You understand and agree that Star Focus is entitled to use reasonable judgment when taking steps to protect against behaviors in violation of relevant laws and regulations or this Agreement. Star Focus may take appropriate legal actions against anyone who violates laws and regulations and save and report the relevant information to relevant authorities in accordance with laws and regulations. You shall bear all legal liabilities incurred thereof.

7. Dispute settlement

The validation, fulfillment, interpretation, and dispute settlement of this Agreement shall be governed by the laws of the USA. If any dispute arises concerning the content or performance of this Agreement, the dispute shall be settled through negotiations made in good faith between the parties in dispute. In the event that the dispute cannot be settled through negotiation, you and Star Focus agree that the courts of the USA have non-exclusive jurisdiction to hear and determine any disputes, claims, actions, or proceedings that may arise out of or in connection with the terms. However, this does not prevent Star Focus from instituting proceedings outside of the USA.

8. General Terms

8.1 If any court or authority deems any provision(s) within this Agreement invalid, the other provisions in this Agreement shall remain unaffected to the greatest extent permitted by the interpretation of the law.

8.2 The section headings in this Agreement are for ease of reading only, and do not have any legal or contractual effect.

8.3 You shall not transfer, assign, or subcontract obligations or rights under this Agreement.

8.4. Star Focus may distribute and transfer all or part of the rights and obligations under this Agreement at any time by prior notice.

8.5. You hereby agree that if Star Focus fails to implement or enforce any legal rights or right to compensation under this Agreement, it shall not constitute a waiver of any provision or clause of this Agreement by Star Focus. The Terms constitute the entirety of this Agreement between you and Star Focus for the use of this Service.
